These Terms and Conditions govern the use of our website and the booking of trips, tours, expeditions and adventure experiences organised or sold by The Side Quest Adventures LTD (“we”, “us”, “our” or the “Company”).

By making a booking, paying a deposit or participating in one of our trips, you agree to these Terms and Conditions, together with the specific trip description and booking conditions provided to you before purchase.

1. About Us

The Side Quest Adventures LTD is a UK-registered company providing adventure travel experiences, group expeditions and organised trips in selected destinations worldwide.

Our trips are designed to offer distinctive experiences, cultural encounters and adventures outside conventional travel itineraries.

Each trip may involve different activities, destinations, accommodation arrangements, transport and levels of physical difficulty. The specific inclusions, exclusions, itinerary and requirements for each trip will be described on the relevant booking page or in the information supplied before booking.

2. Eligibility and Booking

2.1. You must be at least 18 years old to make a booking unless we expressly agree otherwise in writing.

2.2. By booking, you confirm that the information you provide is accurate and complete.

2.3. Your booking is subject to availability and confirmation by the Company. Submitting an enquiry or registering interest does not, by itself, guarantee a place.

2.4. A booking becomes binding when we accept it and confirm it in writing, subject to any applicable statutory cancellation rights.

2.5. You are responsible for reading the trip description, inclusions, exclusions, payment schedule, cancellation conditions and any specific requirements before completing your booking.

2.6. If you book on behalf of other travellers, you confirm that you have their authority to make the booking and provide the relevant information.

2.7. Each traveller is responsible for ensuring that their passport, visa, travel documents and personal circumstances meet the requirements of the destination and trip.

3. Prices, Deposits and Payments

3.1. Prices are displayed in the currency stated on the relevant booking page. Unless expressly stated otherwise, prices are quoted per person.

3.2. A deposit may be required to secure a place. The amount of the deposit and the deadline for paying the remaining balance will be specified on the relevant trip page or booking confirmation.

3.3. Paying a deposit does not mean that the entire trip price has been paid. Any outstanding balance must be paid by the stated deadline.

3.4. Failure to pay an outstanding balance by the deadline may result in cancellation of your booking, subject to applicable law and any required notice. Any cancellation charge must be lawful, fair and justifiable.

3.5. We reserve the right to cancel an unconfirmed reservation or decline a booking where availability, eligibility or other legitimate booking requirements are not met.

3.6. Payments must be made using the payment methods offered during checkout or otherwise agreed with us in writing.

3.7. We will not impose additional charges after booking except where permitted by applicable law and the contract agreed with you.

4. Minimum Group Size and Trip Confirmation

4.1. Certain trips may require a minimum number of participants to operate safely or economically.

4.2. Where a minimum group size applies, it will be disclosed before you book, together with any relevant confirmation deadline.

4.3. If the minimum number is not reached, we may cancel the trip in accordance with the booking conditions and applicable law.

4.4. If we cancel a trip, we will inform affected travellers as soon as reasonably possible and provide any refund or other remedy required by law. Where the applicable package-travel rules require a full refund, we will provide it within the legally required timeframe.

4.5. Travellers should not purchase non-refundable flights or incur other substantial non-refundable expenses in reliance on a trip that has not been confirmed, unless we have expressly confirmed otherwise in writing.

5. Cancellations by Travellers and Refund Policy

5.1. If you wish to cancel your booking, you must notify us in writing using the contact details provided above. The date we receive your cancellation notice will be used to assess the applicable cancellation conditions.

5.2. Our standard cancellation policy is intended to operate as follows, subject always to applicable consumer and package-travel legislation:

  • Within 48 hours of booking: a full refund of payments made, where this policy applies and subject to any mandatory statutory rules.

  • After the first 48 hours and more than 30 days before departure: a refund of 50% of the amount paid.

  • Within 30 days of departure: bookings are generally non-refundable under this standard policy, except where a refund or other remedy is required by law or expressly agreed by us.

5.3. These standard percentages are not intended to override mandatory cancellation rights. If applicable law requires a different outcome, including an appropriate and justifiable cancellation fee or a full refund in exceptional circumstances, the applicable legal requirements will take precedence.

5.4. Where package-travel legislation applies, cancellation charges must comply with the relevant legal requirements and may need to reflect the timing of cancellation, costs saved and the ability to resell the relevant travel services.

5.5. We may request reasonable supporting information where necessary to process a cancellation or refund.

5.6. Approved refunds will normally be returned to the original payment method unless otherwise agreed or required by law. Processing times may depend on the payment provider.

5.7. If you do not arrive at the agreed meeting point, arrive too late to participate, leave the trip early or choose not to participate in an activity, you will not automatically be entitled to a refund. This does not affect any rights you may have under applicable law.

5.8. Travel insurance may cover certain personal cancellation circumstances, subject to the terms of your insurance policy.

6. Cancellations or Changes by Us

6.1. We may need to cancel, postpone or modify a trip because of insufficient participants, supplier failure, safety concerns, political instability, extreme weather, natural disasters, transport disruption or other circumstances affecting the operation of the trip.

6.2. Where reasonably possible, we will notify affected travellers promptly and explain the available options.

6.3. If we cancel a trip, you will receive the refund, alternative arrangements or other remedy required by the applicable contract and law.

6.4. We will not treat an event as automatically eliminating our obligations simply because it is outside our control. Any cancellation, refund or compensation will be determined in accordance with applicable law.

6.5. We may make reasonable changes to itineraries where necessary for safety, operational reasons or circumstances beyond our reasonable control. Where a change significantly affects an essential element of a package, we will provide the options and remedies required by law.

6.6. We will not materially reduce the services promised without providing any remedy required under the applicable contract or law.

7. Flights, Visas and Travel Documents

7.1. Unless expressly included in the relevant trip description or booking confirmation, international flights, visas, passport fees and travel to the starting point of the trip are not included in the price.

7.2. You are responsible for checking passport validity, visa requirements, entry conditions, vaccination or health documentation requirements and any transit requirements applicable to your nationality and itinerary.

7.3. You should check official government travel advice before departure and comply with the entry, immigration and customs rules of every destination.

7.4. If you cannot travel because you lack the necessary documents or are refused entry, you may incur additional costs and may not be entitled to a refund, subject to applicable law and the circumstances of your booking.

7.5. If flights or other transport are expressly included in a package, the applicable booking confirmation and mandatory travel legislation will govern the relevant arrangements and protections.

8. Adventure Activities and Personal Responsibility

8.1. Our trips may involve remote locations, off-road transport, desert expeditions, hiking, water-based activities, outdoor adventures and other activities carrying inherent risks.

8.2. You acknowledge that adventure travel can involve unpredictable weather, difficult terrain, limited facilities, challenging transport conditions, physical exertion and restricted access to medical services.

8.3. You must follow reasonable safety instructions issued by our team, local guides, activity operators and other authorised personnel.

8.4. You must not participate in an activity if you reasonably believe that doing so would put you or another person at serious risk. You should communicate any relevant concerns to the trip leader.

8.5. Certain activities may be operated by independent third-party providers. Where this is the case, the relevant provider's lawful safety requirements and activity-specific conditions may also apply.

8.6. Nothing in these Terms excludes any responsibility that the Company has under applicable law for the services it has agreed to provide.

9. Health, Fitness and Accessibility

9.1. You are responsible for assessing whether you are physically and practically able to participate in the trip and its advertised activities.

9.2. Before booking, you should carefully review any stated fitness, mobility, age or equipment requirements.

9.3. You must inform us in advance of any relevant accessibility requirements or circumstances that could reasonably affect safe participation, to the extent necessary to make suitable arrangements.

9.4. We may request additional information where reasonably necessary to assess safety or determine whether an activity is suitable. Any personal information provided will be handled in accordance with applicable data protection law.

9.5. We will consider reasonable requests and will not discriminate unlawfully. Where a particular activity cannot safely or reasonably accommodate a requirement, we will explain the position and discuss available options where practicable.

10. Travel Insurance

10.1. We strongly recommend that all travellers obtain appropriate travel insurance before departure.

10.2. Your policy should cover the destination, the duration of your trip, relevant adventure activities, emergency medical treatment, evacuation or repatriation where appropriate, personal belongings and cancellation or interruption.

10.3. You are responsible for checking the exclusions, limits and conditions of your policy.

10.4. We do not provide insurance unless expressly stated in writing.

10.5. A failure by your insurer to provide cover does not, by itself, determine the Company's obligations under the booking contract or applicable law.

11. Itineraries, Local Conditions and Suppliers

11.1. Trip itineraries are planned in advance but may be affected by local conditions, weather, transport availability, government restrictions, safety considerations and the decisions of local authorities or service providers.

11.2. We will make reasonable efforts to deliver the advertised experience and any included services.

11.3. Where an advertised service becomes unavailable, we may offer a reasonable alternative where appropriate and permitted by law.

11.4. Accommodation standards, transport types, facilities and local services may differ from those familiar to travellers in their home countries. Material details will be provided in the trip description where relevant.

11.5. We will not promise a particular wildlife sighting, weather condition, transport departure, cultural event or other outcome that is inherently uncertain.

11.6. We will comply with our applicable obligations regarding the performance of travel services and will provide assistance to travellers where legally required.

12. Traveller Conduct

12.1. All travellers must treat other participants, guides, local communities, suppliers and members of the public with respect.

12.2. Harassment, violence, unlawful conduct, deliberate damage, serious disruption or behaviour that creates a significant safety risk will not be tolerated.

12.3. Travellers must comply with applicable laws and reasonable instructions concerning safety, environmental protection and respect for local customs.

12.4. Where a traveller's conduct presents a serious and immediate risk, we may take reasonable steps to protect the group, including removing the traveller from a particular activity or, where justified, ending their participation.

12.5. Any decision to remove a traveller from a trip will be proportionate to the circumstances and subject to applicable law. Any entitlement to a refund will be assessed under the booking contract and relevant legal requirements.

12.6. Travellers may be responsible for losses or damage they directly cause through unlawful conduct or a breach of these Terms, to the extent permitted by law.

13. Personal Belongings and Equipment

13.1. You are responsible for bringing appropriate clothing, equipment, medication, travel documents and other personal essentials specified in the trip information.

13.2. You should take reasonable precautions to protect your valuables, electronic devices, cash and travel documents, particularly during remote expeditions or activities involving dust, water, extreme temperatures or rough transport.

13.3. Unless expressly agreed otherwise, you are responsible for the safekeeping of your personal belongings.

13.4. Nothing in this section excludes or limits liability where the Company is legally responsible for loss or damage.

14. Liability

14.1. We will perform the services we have agreed to provide with the standard of care and responsibility required by applicable law.

14.2. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot lawfully be excluded or limited.

14.3. Where applicable package-travel legislation applies, the Company's responsibilities and liabilities will be governed by that legislation and the relevant booking contract.

14.4. We are not responsible for losses caused solely by circumstances for which we are not legally responsible, including a traveller's independent decisions or the acts of third parties where the law does not impose responsibility on us.

14.5. We will not exclude a traveller's statutory rights or any remedy available under mandatory consumer-protection legislation.

14.6. Nothing in these Terms is intended to prevent a traveller from bringing a valid claim where the Company has failed to fulfil a legal or contractual obligation.

15. Complaints and Assistance

15.1. If you experience a problem during a trip, please notify the trip leader or our designated contact as soon as reasonably practicable so that we have an opportunity to address it.

15.2. If the issue cannot be resolved during the trip, you may submit a written complaint to our contact email, explaining the circumstances and including any relevant supporting information.

15.3. We will review complaints fairly and respond within a reasonable period.

15.4. Nothing in this section requires you to give up any statutory rights or prevents you from contacting an appropriate consumer-protection body or seeking legal advice.

15.5. Where required by law, we will provide reasonable assistance to travellers who are in difficulty during a trip.

16. Photography, Video and Marketing

16.1. Our trips may involve group photography, video recording and the creation of travel content.

16.2. We may request permission to use identifiable photographs or video footage of travellers for promotional purposes.

16.3. Where consent is required, we will seek it separately and will not make consent a condition of booking where it is not necessary for providing the trip.

16.4. You may tell us if you do not wish to be included in promotional material. We will take reasonable steps to respect that request, subject to practical limitations and any applicable law.

16.5. Travellers must respect the privacy of other participants and obtain any necessary permission before publishing identifiable images of them.

17. Website Use and Intellectual Property

17.1. Unless otherwise stated, the website's text, branding, logos, graphics, photographs, videos and original marketing materials are owned by or licensed to The Side Quest Adventures LTD.

17.2. All rights are reserved. You may not reproduce, distribute, commercially exploit or modify our protected materials without prior written permission, except where permitted by law.

17.3. You may use the website for lawful personal purposes and must not misuse its booking systems, interfere with its operation or attempt unauthorised access.

17.4. Third-party names, logos and materials remain the property of their respective owners.

18. Privacy and Personal Information

18.1. We collect and use personal information where reasonably necessary to process bookings, communicate with travellers, arrange trips, meet legal obligations and provide customer support.

18.2. Personal information will be handled in accordance with applicable data protection legislation and our separate Privacy Policy.

18.3. Where necessary to organise a trip, relevant information may be shared with guides, accommodation providers, transport operators, activity providers or other service providers involved in delivering the booked services.

18.4. We will take appropriate steps to handle personal information lawfully and securely.

18.5. Please refer to our Privacy Policy for further details regarding data collection, use, retention and your rights.

19. Third-Party Websites and Services

19.1. Our website may contain links to external websites, payment providers, travel operators or other third-party services.

19.2. We do not control all third-party websites and are not responsible for their content or privacy practices.

19.3. Where a service is provided directly by a third party under a separate contract, the relevant third-party terms may apply. This does not remove any responsibility the Company has under the booking contract or applicable law.

20. Exceptional Circumstances

20.1. Events such as natural disasters, severe weather, armed conflict, civil unrest, public-health emergencies, government restrictions or major transport disruption may affect a trip.

20.2. If such circumstances arise, we will assess the available options, prioritise reasonable safety measures and communicate material changes to affected travellers.

20.3. Any right to cancel, receive a refund, obtain alternative arrangements or claim compensation will be determined in accordance with the applicable contract and law.

20.4. This section does not remove any mandatory refund, assistance or compensation obligations that apply to the Company.

21. Amendments to These Terms

21.1. We may update these Terms from time to time to reflect changes in our services, business practices or legal requirements.

21.2. The latest version will be displayed on our website with its revision date.

21.3. Changes will not retrospectively remove contractual or statutory rights that have already accrued to a traveller.

21.4. The Terms applicable to a confirmed booking will be determined by the booking contract, any valid agreed variations and applicable law.

22. Governing Law and Jurisdiction

22.1. These Terms are governed by the laws of England and Wales, subject to any mandatory consumer-protection rules that apply to a traveller.

22.2. Any dispute will be dealt with by the courts having jurisdiction under applicable law.

22.3. Nothing in this section deprives a consumer of any mandatory rights they may have to bring proceedings in another competent jurisdiction.
